Newkirk is the second consumer in this country to ever be diagnosed with bronchiolitis obliterans, although other home users of popcorn are undergoing medical evaluation at this time.
'I just loved popcorn, and I would eat four to six bags a day,' Newkirk told the Seattle P-I, 'especially the ones with lots of butter that taste like you're going to the theater.'
In a lawsuit filed Thursday in U.S. District Court in Spokane, the popcorn was identified as 'Act II,' which is produced with several other brands by ConAgra Foods.
In addition to ConAgra, the suit names Shopko Stores, where he bought the product, and at least five national and international companies that make or have made the diacetyl-based flavoring. All of the flavor companies are currently the target of other suits, but mostly for workers.
ConAgra, the nation's largest producer of microwave popcorn, could not be reached for comment, but in response to questions asked earlier this week for another story, company spokeswoman Stephanie Childs said, 'ConAgra Foods completed its work to remove added diacetyl from all of its microwave popcorn brands before the end of 2007.'
'I was a healthy, active guy who could play golf for hours on end and haul building supplies all over the place and never get tired,' said Newkirk, who owns a wholesale building material operation. 'Now, I can't walk up a flight of stairs without stopping halfway up.'
For more than two years he went from physician to physician trying to identify the cause of his breathing difficulties.
'They tried everything,' he explained. 'First it was my heart, then my stomach, then sleeping problems
